The University Council makes recommendations on profile development and improving the performance and competitiveness of the university. In fulfilling its tasks, it takes into account the higher education development planning of the Free State of Saxony in accordance with Section 11 (1) and the target agreements in accordance with Section 11 (2) SächsHSG.

The University Council consists of eleven members.

Tasks of the University Council

The University Council is responsible for

  1. appointing the three members of the University Council for the selection committee in accordance with Section 87 (6) sentence 2 number 1,
  2. applying to the Extended Senate for the dismissal of the Rector,
  3. confirming the dismissal of the Rector by the Extended Senate,
  4. Giving consent to the Rector's proposal for the appointment of the Chancellor,
  5. Approving the University's development plan,
  6. Approving the business plan of the University and the Faculty of Medicine,
  7. Formulating principles for the use of positions and funds in accordance with Section 12 (6) sentence 2 and the use of reserves in accordance with Section 12 (6) sentence 4,
  8. approval of the annual financial statements and the management report of the University and the Faculty of Medicine,
  9. approval of the actions of the Rectorate and the Dean's Office of the Faculty of Medicine,
  10. opinion on the intended information of the public by the Rectorate pursuant to Section 88 (3) sentence 1 no. 12,
  11. opinion on the Rectorate's report in accordance with Section 11 (6) sentence 4,
  12. appointment of the auditor of the Faculty of Medicine's financial statements at the suggestion of its Dean's Office in agreement with the State Ministry and the State Ministry of Finance,
  13. opinion prior to the conclusion of target agreements.

The University Council can give its opinion on the resolution on the basic regulations and their amendment as well as on the establishment, cancellation and significant amendment of study programmes.

§ 13 University Council

The University Council consists of 11 members. In the case of management in accordance with Section 11 (5) sentence 1 SächsHSG, the University Council consists of 9 members, in deviation from sentence 1.

§ 86 University Council

(1) The University Council shall make recommendations on profile development and improving the performance and competitiveness of the university. It shall take into account the higher education development planning of the Free State of Saxony pursuant to Section 10(1) and the target agreements pursuant to Section 10(2). It is responsible for

  1. preparing a proposal for the election of the Rector,
  2. applying to the Extended Senate for the dismissal of the Rector,
  3. confirming the dismissal of the Rector by the Extended Senate,
  4. Giving consent to the Rector's proposal for the appointment of the Chancellor,
  5. Approving the University's development plan,
  6. Approving the draft business plan,
  7. Formulating principles for the use of positions and funds in accordance with Section 11 para. 6 sentence 2 and the use of reserves pursuant to Section 11 para. 6 sentence 3,
  8. approval of the annual financial statements,
  9. approval of the actions of the Rectorate,
  10. opinion on the Rectorate's annual report pursuant to Section 10 para. 4 sentence 4,
  11. opinion prior to the conclusion of target agreements.

It may issue an opinion on the establishment, significant modification and discontinuation of degree programmes. In matters of sentence 3 no. 5, 6 and 11, the University Hospital shall be consulted insofar as its affairs are affected.

(2) The University Council shall consist of 5, 7, 9 or 11 members. The number is regulated by the Basic Regulations. Up to a quarter of this number, but at least 2 members of the University Council, may be members or affiliates of the university. The members are personalities from science, culture, business or professional practice who are familiar with the university system. The representatives of the university are not members of the Senate or the Rectorate. The members of the University Council are independent in their activities on the University Council and are not bound by instructions.

(3) The Senate appoints less than half of the number of members stipulated in the basic regulations, in particular all members or members of the university in accordance with paragraph 2 sentence 3. The remaining members are appointed by the state government. The student senators may submit a proposal for the appointment to the Senate.

(4) In the case of management in accordance with Section 11 (5) sentence 1, the University Council shall consist of 5, 7 or 9 members in deviation from paragraph 2 sentence 1. By way of derogation from paragraph 3 sentences 1 and 2, the Senate shall appoint one member of the University Council more than half of the number of members stipulated in the basic regulations, in particular all members or members of the university in accordance with paragraph 2 sentence 3. The remaining members shall be appointed by the State Ministry of Science and the Arts.

(5) The State Ministry of Science and the Arts shall appoint the members; it may dismiss a member for good cause. Reappointment is possible.

(6) The University Council elects an external member as chairperson. The university shall set up an office for the University Council. The University Council shall meet at least twice a semester and as required. The Rectorate has the right of initiative to convene meetings. The University Council meets at least once a year together with the elected senators in accordance with Section 81 Para. 2. The Rectorate presents its proposals to the University Council; the members of the Rectorate are obliged to attend its meetings on request. All university bodies are obliged to provide information and documents upon request. If objections are raised, it shall work towards clarification within the university. In the event of serious complaints, it shall inform the State Ministry of Science and the Arts.

(7) The Rectorate shall report to the University Council in writing at least once a semester and upon request on the development of the budgetary and economic situation and on the financial impact of appointment agreements.

(8) Representatives of the State Ministry of Science and the Arts may attend the meetings of the University Council with the right to speak.
